Terms of Service
Last updated: 29 September 2026
These terms are the agreement between you and Protosoftware Ltd (trading as Proto Software), a company registered in Northern Ireland (company number NI639082, registered office 154 Newtownsaville Road, Eskra, Omagh, Co Tyrone, BT79 0BR), for your use of Proto Brand Builder. By creating an account or using the service, you agree to them.
1. The service
Proto Brand Builder helps you create a brand kit (website templates, logo ideas, social media graphics and captions), edit websites in a drag-and-drop builder, and design social media posts. We may add, change or remove features over time. If we remove something important from a paid plan, we'll tell you in advance.
2. Your account
- You must be 18 or over and use Proto Brand Builder for a business, club, charity or similar purpose.
- Give accurate details, keep your password private, and tell us straight away if you think someone else has used your account.
- You're responsible for everything done through your account.
3. Plans and payment
- You can build and preview for free. Paid plans unlock extra features, as described on our pricing page at the time you subscribe.
- Paid plans are billed in advance, monthly or yearly, through our payment provider. Prices include VAT where it applies.
- You can cancel at any time. Your plan stays active until the end of the period you've paid for, and then won't renew. We don't refund part-used periods, except where the law requires.
- If we change our prices, we'll give you at least 30 days' notice before the change affects you, and you can cancel before it does.
- If you're a consumer, nothing in these terms affects your legal rights, including your right to cancel within 14 days under the Consumer Contracts Regulations.
4. Your content
- You own the content you add: your text, photos, logos and business details.
- You give us permission to store, copy, display and process that content only as needed to run the service for you. This permission ends when you delete the content or your account.
- You confirm you have the right to use everything you upload, and that it doesn't infringe anyone else's rights.
5. Templates and suggested content
Our templates include suggested wording, sample testimonials (such as "A happy customer") and sample figures (such as "500+ happy customers"). These are placeholders. Before you publish, replace them with genuine reviews and accurate facts about your business, or remove them. Publishing fake reviews or misleading claims is against UK consumer protection law, and you are responsible for what appears on your website and posts.
The designs you create are yours to use for your business. The Proto Brand Builder software, templates and brand remain ours, and you may not copy or resell them as a competing template product.
6. Acceptable use
Don't use Proto Brand Builder to create or share content that:
- is illegal, fraudulent or misleading, including phishing pages or impersonating another business;
- is hateful, harassing, violent, sexually explicit, or exploits children;
- infringes someone else's copyright, trade marks or privacy;
- contains malware, or tries to attack, overload, scrape or get unauthorised access to the service.
We may remove content or suspend accounts that break these rules. Where it's appropriate, we'll tell you why and give you a chance to put things right.
7. Availability
We work hard to keep Proto Brand Builder running, but we can't promise it will always be available or free of errors. Please keep your own copies of important work. You can export any website as an HTML file and download your data at any time.
8. Liability
- Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't legally be limited.
- Otherwise, we're not liable for loss of profits, revenue, business, goodwill or data, or for indirect or consequential losses.
- Our total liability to you in any 12-month period is limited to the greater of the fees you paid us in that period and £100.
9. Ending the agreement
You can stop using Proto Brand Builder and delete your account at any time from Account settings. We may suspend or close your account if you seriously or repeatedly break these terms, or if we have to by law. If we close the service altogether, we'll give you at least 30 days' notice so you can export your work.
10. Changes to these terms
We may update these terms. If a change matters, we'll tell you at least 30 days before it takes effect. Carrying on using the service after that means you accept the new terms.
11. Law
These terms are governed by the law of Northern Ireland, and the courts of Northern Ireland have jurisdiction. If you're a consumer living elsewhere in the UK, you can also bring claims in your local courts, and you keep the protection of your local consumer law.
